Terms of Service

These Terms of Service ("Terms") govern your access to and use of the QuestLore platform and related services (collectively, the "Service") operated by QuestLore ("we", "our", "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

1. Eligibility

You must be at least 16 years old to use QuestLore. By using the Service, you confirm that you meet this requirement. Use of QuestLore is intended for business purposes, and accounts are created on behalf of or within an organisation.

2. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must provide accurate and complete information when registering and keep it up to date.
  • You must notify us immediately at hello@qlore.space if you suspect unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions & Payment

Billing

Access to QuestLore requires a paid subscription for organisations above the free-tier limits. Subscription fees are billed in advance on a monthly or annual cycle, as selected at checkout. All prices are exclusive of applicable taxes (e.g. VAT) unless stated otherwise.

Payment Processing

Payments are processed securely by Stripe. By providing your payment details you authorise us to charge the applicable fees. We do not store your full card details.

Renewals & Cancellation

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time from your billing settings; you will retain access until the end of the current period and will not be charged again.

Refunds

We offer a 14-day money-back guarantee for new subscriptions. After this period, fees are non-refundable except where required by applicable law.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorised access to any part of the Service or its related systems
  • Upload, transmit, or distribute malware, spam, or other harmful content
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access or interact with the Service without our written permission
  • Impersonate another person or organisation
  • Manipulate or artificially inflate XP, coins, achievements, or any other gamification metric

5. Gamification Content

XP, coins, levels, achievements, and leaderboard standings ("Gamification Metrics") are virtual and have no monetary value outside the QuestLore platform. They cannot be transferred between organisations or exchanged for cash.

Rewards redeemed with coins are subject to availability and the terms set by the organisation administrator. QuestLore is not responsible for the fulfilment of rewards configured by your organisation.

6. Intellectual Property

Our Content

The QuestLore platform, including its software, design, trademarks, and documentation, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes.

Your Content

You retain ownership of any content you upload to the platform (e.g. quest descriptions, reward images). By uploading content, you grant us a non-exclusive licence to store, display, and process it solely for the purpose of providing the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described therein.

8. Availability & Modifications

We aim to provide the Service 24/7 but do not guarantee uninterrupted availability. We may perform scheduled or emergency maintenance that temporarily limits access.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by applicable law, QuestLore shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

Either party may terminate the agreement at any time. You may do so by cancelling your subscription and ceasing to use the Service. We may terminate or suspend your access immediately if you breach these Terms or if we are required to do so by law.

Upon termination, your right to use the Service ceases. We will retain your data for up to 30 days to allow you to export it, after which it will be deleted in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts. If you are an EU consumer, you retain the benefit of any mandatory protections provided by the laws of your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
